DMCA / Copyright Notice

Control Plane Labs respects the intellectual property of others. If you believe that content on this site infringes your copyright, you may submit a notice of infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

What your notice must contain

To be effective under the DMCA, your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work you claim has been infringed. If multiple works are involved, a representative list.
  3. Identification of the material you claim is infringing, with enough detail for us to locate it. The URL of the specific page on this site is ideal.
  4. Your contact information: name, mailing address, telephone number, email address.
  5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Incomplete notices may not be actionable.

What happens next

  • We review every valid DMCA notice within 5 business days of receipt.
  • If the notice is valid, we remove or disable access to the material identified in the notice and notify the person who posted it.
  • We may reinstate the material if the person who posted it submits a valid counter-notice and the original complainant does not initiate a legal proceeding within 10-14 business days.

Counter-notice

If content of yours was removed in response to a DMCA notice and you believe the removal was in error, you may submit a counter-notice containing:

  1. Your physical or electronic signature.
  2. Identification of the material removed, and the location it appeared at before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of the federal district court for the Western District of Michigan and will accept service of process from the original complainant.

Repeat infringers

In accordance with the DMCA, we terminate the ability to post content of users who are determined to be repeat infringers.

Bad-faith notices

Filing a DMCA notice in bad faith may expose you to liability under 17 U.S.C. § 512(f). Please make sure you actually own the copyright to the material you are asserting a claim over.
